Eva Schumm,
I had received your response from my e-mail and letter for request enter the national phase but you did not accordingly stipulate the PCT law and before usual practice, therefore make me feel very unwell.
In the notification of by the International Bureau on September 4, 2003 that a ATTENTIO:
“ The applicant should carefully check the data appearing in this Notification. In case of any discrepancy between these data and the indications in the international application, the applicant should immediately inform the International Bureau. “
From now onwards, International
Bureau was substituted the receiving office immediately.
The designations fee made under Rule 4.9(a)(i) for the purpose of obtaining national patents, I
had paid up the designations fee on July. 15, 2003.
The designations made under Rule 4.9(c)(i) for filing with the receiving Office a written notice containing an indication as referred to in paragraph (a)(i) or (ii) for the purpose of obtaining national patents, in this stage, the “ ANNEX TO FORM PCT/IB/301” had notification that:
“ the applicant is reminded that the "national phase" must be entered before each of the designated Offices indicated on the cover sheet of this Notification by paying national fees and furnishing translations”
Therefore, in this stage of "national
phase", it's applicant’s responsibility for designated these countries and the receiving office pass on the national fees and furnishing translations with the confirmation fee to your International Bureau! The confirmation fee under Rule 4.9(c) and 15.5 is 50% of the designation
fee due. The Rule 15.5 to stipulation:
“shall be subject to the payment to the receiving Office of as many
designation fees (for the benefit of the International Bureau) ”
Therefore, the confirmation fee is distribution from 50% of as many designation fees from the receiving Office! The got benefit of the International Bureau’s responsibility must to completed the "national phase" till a application number from the designated countries was approved! Otherwise, why would it be a national phase?
It is weird to request applicant isolated to every
designated country to apply? Let down the designation and confirmation cost of
applicant and violate PCT Law and violate human rights further now!
The Austrian Patent Office a service promise on her websites that stated "Search on the state of the art concerning a concrete technical problem within 2 - 4 weeks. " i would like to know what had caused that delay in getting the search report?
